Agile Delivery Accelerators Ltd – Terms and Conditions – Updated 2023-08-01

  1. Introduction

This is a legally binding agreement between you the user (“you”, “participant” or “user”) of the website accelerators.co.uk and Agile Delivery Accelerators Limited (“Accelerators Ltd”, “Accelerators”, “we,” “us,” or “our”). By accessing or using our website & content, participating in our training and coaching events & workshops, you agree to comply with and be bound by these Terms and Conditions.

This document should be read in conjunction with our privacy policy which outlines how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in our Privacy Policy

We reserve the right to modify these Terms without prior notice. It is your responsibility to periodically review these terms and conditions. Your continued use of our website, enrolment in our training events, workshops or other services provided by Accelerators after changes have been made indicates your acceptance of the updated terms. 

  1. Intellectual Property & Use of the Accelerators Website
    • Website Content: The material and content in this website are protected by applicable copyright and trademark law. The Accelerators service descriptions and Logo are the copyrights and trademarks of Accelerators Ltd. By using this website, you agree not to infringe these copyrights or trademarks, and not to reproduce, distribute or share the content on this website without explicit prior written approval from Accelerators Ltd.
    • Course Materials (Scaled Agile): The Scaled Agile course content, presentations and videos are the copyright of Scaled Agile Inc, USA. All course material made available by Scaled Agile Inc, remains the intellectual property of Scaled Agile Inc.
    • Course Materials (Accelerators Ltd): All other course materials, including but not limited to any presentations, videos, documentation, learning exercises, use cases and other content provided by accelerators during training events & workshops are the intellectual property of Accelerators Ltd. By attending our training events and workshops, you are granted a non-transferable, revocable licence to view and use this material for personal, non-commercial, learning activities. You agree not to reproduce, distribute, or share this materials without our explicit permission.
    • Third Party intellectual property: Accelerators respects the intellectual property right, copyrights and trademarks of all third parties. Where we provide links to other sites, videos and material, this is for information only, and users are expected to review the usage policies and respect the intellectual property right, copyrights and trademarks of such third parties.
  1. Course & Workshop Registration, Payments and Refunds
    • Registration and Payment: Our website allows you to request registration on a training event, without requiring immediate payment. It’s our policy to treat you as a unique individual, to engage with you & discuss your training requirements, understand your aspirations and current level of experience, and to recommend & register you on to the most appropriate training event(s).  By using our website, you consent to being contacted by an Accelerators SPC, to discuss your requirements, and register you on a training event.

You agree to provide us accurate personal information about you whilst registering for training events. The same information will be used to register you with Scaled Agile or other accrediting body, and will be displayed on your certifications. You agree to pay Accelerators Ltd any costs it incurs to rectify records with accrediting bodies, as a result of you providing inaccurate or incomplete data to us.

 

An invoice with payment instructions will be issued to the participant(s) once the training events and dates have been agreed, and full payment will be required at this point to secure the booking.

The registration and payment in full must be completed a minimum of 10 working prior to the actual remote training event or workshop, which enable us to guide you through the pre-course content, issue any required printed material, and prepare you for the event.

 

By registering for our events, you agree to meet the above payment timeframe, and take part in our pre-course engagements and exercises. You further agree that all pre-course engagements, and remote training events will be conducted on camera, and that you have suitable equipment and internet bandwidth to support remote learning.

  • Cancellation and Refunds: Cancellation and refunds policy will depend on the type of training event as outlined below.

 

 

No refunds will be provided for training events or workshops completed in whole or in part, or where the participant(s) do not attend the event.

  1. Delivery of Training Events & Workshops
    • Remote/online Events: For these events, you will receive access details and materials electronically. You are responsible for ensuring you have the necessary hardware, software and connectivity to access the materials, online training event and any 3rd party solutions, including but not limited to; video conferencing tools, online collaboration tools, and online document repositories. While we make reasonable effort support our participants gain access, technical difficulties experienced by participants are not the responsibility of Accelerators Ltd.
    • In-Person/Classroom Events: For in-person courses, you are responsible for your own transportation, accommodation, and other logistics.
    • Event Schedule: Participants will be provided an events schedule containing event start, finish and break times for both remote and classroom Events. Participants are expected to join remotely or arrive on time and participate actively in all scheduled training activities.

We retain the right to cancel or reschedule any training events or workshops, change the workshop facilitator or instructor, or to modify the event schedule and the order in which training topics are delivered. 

  • Course Materials: Attendees will receive course materials, which are for personal use only. Reproduction, distribution, or sharing of course materials without prior written consent from copyright owners is strictly prohibited.
  • Code of Conduct: We expect all event participants to treat instructors and fellow participants with respect and professionalism during in-person and online interactions. Harassment, discrimination, and any form of disruptive behaviour will not be tolerated. We reserve the right to remove participants who engage in such conduct without a refund.
  • Examinations & Accreditation: Examinations and Accreditation for specific training events will be provided by third parties such as Scaled Agile Inc. Accelerators will register the participant with relevant third parties for the purpose of conducting their examinations. Any additional fees or fees for examination re-takes imposed by the third party will be the sole responsibility of the participant
  1. Intellectual Property: All course content, materials, and intellectual property provided during the training are the exclusive property of Accelerators Ltd and/or the instructor, other than the content provided by third parties such as Scaled Agile Inc, which will remain their intellectual property. You agree not to record, share, or distribute any course content without express written consent from the intellectual property owner.
  1. Disclaimer: The information provided on the Accelerators website is for general informational purposes only. We strive to ensure that the content is accurate and up-to-date, but we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Limitation of Liability: Neither Accelerators Ltd, its licensors, employees, directors or suppliers will be held liable by you or any other third party for any indirect, incidental, special, or consequential damages whatsoever, including, but not limited to, loss of revenue or profit, loss or damaged to data, disruption to work, or other commercial, economic or reputational loss, even if Accelerators has been informed of the possibility of such damages or if they are foreseeable. In no circumstances shall Accelerators (licensors, employees, directors or suppliers) total liability to you for damages, losses, and causes of action, whether in contract, tort (including, but not limited to, negligence), Strict Liability or otherwise, exceed £1 GBP. These limitations apply irrespective of whether the alleged breach or default is considered a fundamental condition or term or a fundamental breach.

Indemnification: By using the Accelerators website or enrolling on any of our training events or workshops, you agree to indemnify, defend, and hold harmless Accelerators and its affiliates, partners, third-party content providers, licensors, directors, employees, Trainers and coaches, from and against any and all claims, actions, suits, proceedings, judgments, damages, losses, liabilities, costs, and expenses (including, without limitation, reasonable legal fees and related reasonable costs) arising directly or indirectly out of or in connection with:

(a) Your use or attempted use of our website or training events in violation of the Terms, or

(b) Your violation of any law or rights of any third party including, without limitation, any claim of infringement or misappropriation of intellectual property or other proprietary rights.

 

These terms & conditions covers your responsibilities in connection with your use of the Site and participation in training events. It is important to review and understand your obligations under these Terms.
